  • Organic traffic campaign management
  • Geographic and behavioral targeting capabilities
  • Credit-based usage system
  • Analytics and reporting tools
  • API access and integrations

2.2 Service Modifications

We reserve the absolute right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Change features, functionality, or pricing without prior notice
  • Impose limits on certain features or restrict access to parts of the Service
  • Terminate the Service entirely at our sole discretion

2.3 No Guarantee of Availability

The Service is provided on an "as available" basis. We do not guarantee continuous, uninterrupted, or secure access to the Service.

3. ACCOUNT REGISTRATION AND SECURITY

4.2 Credit System

  • Services are consumed through a non-refundable credit system
  • Credits expire according to your subscription terms
  • Unused credits do not roll over unless explicitly stated
  • Credit costs for features may change without notice
  • Credits have no cash value and cannot be exchanged for money

4.3 No Refunds

ALL SALES ARE FINAL. We do not provide refunds for:

  • Unused credits
  • Partial subscription periods
  • Service dissatisfaction
  • Changes to the Service
  • Account termination for Terms violations

4.4 Taxes

You are responsible for all applicable taxes, duties, and governmental assessments. Our fees do not include such charges.

4.5 Chargebacks

Initiating a chargeback or payment dispute without first contacting us will result in immediate account termination and potential legal action.

5. PROHIBITED USES AND CONDUCT

  • Collect or harvest user data without consent
  • Impersonate any person or entity

  • Violate intellectual property rights

5.2 Content Standards

Any content you submit must not:

  • Be false, misleading, or fraudulent
  • Violate any applicable law or regulation
  • Infringe on any intellectual property rights
  • Contain malicious code or harmful components
  • Be obscene, offensive, or inappropriate

5.3 Enforcement

Violation of prohibited uses may result in:

  • Immediate account termination
  • Forfeiture of all credits and fees paid
  • Legal action and prosecution
  • Reporting to law enforcement authorities
  • Claims for damages and injunctive relief

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Our Intellectual Property

All content, features, functionality, and technology comprising the Service, including but not limited to:

  • Software code and algorithms
  • Text, graphics, logos, and images
  • Data compilations and databases
  • Trade secrets and proprietary methods
  • Trademarks and service marks

Are owned by or licensed to NavBoosted and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

  • Traffic quality or conversion rates
  • Compatibility with all websites or platforms
  • Protection from search engine penalties
  • Any particular outcome or result

7.3 Third-Party Services

We are not responsible for third-party services, websites, or content accessed through our Service. Your use of third-party services is at your own risk.

7.4 Information Accuracy

We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

8. LIMITATION OF LIABILITY

8.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  • COST OF SUBSTITUTE SERVICES

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Essential Purpose

These limitations apply regardless of the legal theory and survive any failure of essential purpose of any limited remedy.

9. INDEMNIFICATION

9.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless NavBoosted, Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all:

  • Claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees)

  • All licenses granted to you terminate
  • Sections of these Terms that should survive will remain in effect

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

11.2 Mandatory Arbitration

ANY DISPUTE SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION under the American Arbitration Association's Commercial Arbitration Rules. You waive your right to:

  • Traffic delivery timeframes are estimates only
  • You are responsible for campaign targeting and configuration

15.2 Service Levels

  • We target 99.9% uptime but do not guarantee it
  • Scheduled maintenance may occur with or without notice
  • Service credits or extensions are at our sole discretion

15.3 Data Retention

  • We retain data according to our Privacy Policy
  • Deleted data may persist in backups
  • We may retain data as required by law

15.4 Export Controls

The Service may not be used in violation of U.S. export laws and regulations.

16. SPECIAL PROVISIONS

16.1 Injunctive Relief

You acknowledge that breach of these Terms may cause irreparable harm for which monetary damages are inadequate, and we are entitled to seek injunctive relief.

If you are a government entity, these Terms apply to the maximum extent permitted by law.

16.3 California Residents

If you are a California resident, you waive California Civil Code Section 1542 regarding unknown claims.
